BOWLING GREEN, Ky. (WBKO) - The jury trial for Brian "Slim" Nash was continued for a second time.
According to Nash's attorney, Alan Simpson, the court suppressed some of the evidence including balancing tests performed by police after being told by Nash that he had had multiple knee surgeries.
Simpson says the court ruled that because of Nash's medical condition, these tests should never have been performed and are inadmissible.
The prosecution is seeking to have that decision overturned, so the trial was continued.
Nash is charged with operating a motor vehicle under the influence and improper turning from a 2013 incident.
