State Hearing Officer, Janet C. Thompson, has recommended the permit issued to Apex Environmental by the Natural Resources and Environmental Protection Cabinet be declared void. South Union residents protested from the moment Eddie Hanks opened the waste transfer station in Logan County this past spring.
They asked the Cabinet to revoke his operating license, "because of false, misleading, and/or incorrect information contained in the public notice and application." But the Cabinet disagreed, so the residents sued the Cabinet and Apex Environmental.
Thompson's recommendation to void Apex's permit now goes to Cabinet Secretary, James E. Bickford. Any appeal must be filed within 30 days.
