Robert "Eddie" Shirley is accused of shooting and killing 30-year-old Alfred Victor Michael on January 4, 2004. Kentucky State Police say Shirley arrived home that night to find his wife and Michael in an alleged "sexual embrace."
KSP says Shirley then shot Michael with a 38-caliber revolver. But Tuesday, Shirley's attorney said Shirley and his wife will both testify the shooting was an accident. The case is being heard by Warren Circuit Judge Steve Wilson.
