Robert Eddie Shirley had admitted on the stand, he shot and killed 30-year-old Alfred Victor Michael January 4 of 2004. Shirley saw his wife in a suggestive embrace with Michael when he got home that night, and he got his 38-caliber gun to confront him.
When he did, Shirley said the gun went off by accident. But Assistant Commonwealth Attorney, Mike Pearson, said Shirley had fired the gun in anger, and apparently the jury agreed.
It is recommending 58-year-old Shirley receive a 20-year sentence in state prison. He would have to serve at least 17 years before being eligible for parole.
