NASHVILLE, Tenn. (AP) -- A former U.S. Army Special Forces officer in Dubai says he won't come back to the United States, despite a court order to return his 1-year-old daughter, because his wife needs to return to the United Arab Emirates to face a charge of adultery.

Charles Peters, a former Army major who was stationed at Fort Campbell, is being sued in Tennessee by his wife, Stacy Peters, for custody of their daughter, Caroline, who remains in Dubai with her father.

Charles Peters said in a phone interview with The Associated Press Monday, he won't leave until the criminal case in Dubai is finished. But his wife says she fears she will be jailed if she returns to Dubai.
