Tim Emberton is suing Red Lobster. He claims he contracted Hepatitis-A while dining there in July of 2001.
Emberton is also suing former Red Lobster server, Carissa Phelps and the Barren River District Health Department. He claims they were all negligent, for failing to notify him that he had been exposed to the disease.
At least three other people have sued Red Lobster after allegedly contracting Hepatitis-A there. Some have settled out of court.
