More KY Inmates Released

More than 300 Kentucky inmates will get a taste of freedom as Gov. Patton orders the second early release of non-violent offenders.

There are 328 non-violent inmates who are nearing completion of their sentences to be released at 8 a.m. Friday, Jan. 17.

Gov. Patton says the release is part of the state's continuing effort to offset budget shortfalls for the Department of Corrections.

He has come under fire for his decision to release inmates, especially since at least two of them have already been arrested again.

Conditional Commutation

  • 328 inmates to be released by Executive Order on Friday, Jan. 17, 2003.
  • Number of inmates released is the number required to bring the state’s Class D jail population down to the budgeted level.
  • Release will include only non-violent (as defined by DOC’s classification system, much broader than by statute alone, but also includes all those crimes as well) Class D inmates.

    The following inmates are not included in the application:

    • Felony violent offenders as defined by the Department’s Classification System;
    • Felony sex offenders as defined by the Department’s
      Classification System;
    • Felony sex offenders who failed to register as required by law;
    • Felony DUI offenders; and
    • Felony offenders who have current serious mental health needs who pose a threat to themselves or others.

    Breakdown

  • Class D inmates, 83 from state institutions, 239 from county jails, 6 from halfway houses.

    Jail Facts

  • Under Patton administration, per diem to county jails increased 15 percent, from $25 to $28.76
  • Number of felons housed in county jails increased from 1996 to 2002 from 1,968 to 4,320 (119.5 percent)
  • Jail Capacity: Approximately 14,500; Budgeted Institutional Capacity: 11,788 (includes private prisons)
