A judge in Franklin County ruled Monday that Kentucky Transportation Secretary Bill Nighbert will have to stand trial for allegedly threatening a whistle blower.
Judge Thomas Wingate ruled that a pardon did not cover Nighbert's alleged retaliation against a whistle blower.
A grand jury in Franklin County has been investigating Fletcher's administration on allegations it based personnel decisions on politics.
So far, the special grand jury has indicted 13 current and former officials and associates.
In August, Fletcher pardoned everyone except himself.
Wingate ruled that Nighbert's jury trial in the case should start on July 26.
