Attorneys for three men charged in an alleged hazing incident at an Eastern Kentucky University fraternity are asking to have the case dismissed.
In motions filed in Madison District Court on Thursday, the attorneys also asked for a change of venue in the case.
Two students and an alumnus are charged with fourth-degree assault in the beating of Kappa Alpha Psi pledge Brent Whiteside.
Police said he was beaten with fists, a paddle and a cane and spent several days in a hospital after his kidneys failed.
EKU officials have since suspended the Kappa Alpha Psi fraternity from the school.
The Lexington Herald-Leader reports that attorneys for 21-year-old Thomas Barnes, 22-year-old Gabriel M. McLaren and 32-year-old Alonzo C. McGill are requesting more information about Whiteside's allegations.
A pretrial hearing was scheduled for Aug. 26 in Madison Circuit Court.
