Stumbo filed a motion with Franklin County Circuit Court yesterday seeking to recover the money as part of a 1998 legal settlement.
Kentucky has already recieved more than 100 million dollars for this year's payment, but about 13 million has been placed in a disputed account.
The companies are claiming they shouldn't have to pay the full amount because their market share has shrunk since the agreement was reached eight years ago.
The tobacco industry is facing similar lawsuits across the country.
