Governor Ernie Fletcher gave himself permission to appoint nine judges this November.
A provision requiring the judges be elected was the target of one of the governor's line item vetoes.
Democrats say Fletcher’s action means your being stripped of your right to have a say in the matter.
But a Fletcher spokesman says the election requirement had constitutional problems, and that's why the governor took the provision out.
The nine judgeships include seven in circuit court and two in district court.
