Capital Murder Retrial

In September of 2003, Phillip L. Brown was found guilty of beating and stabbing 36-year-old Sherry Bland to death in her home in January of 2001.

But last year the Kentucky Supreme Court ruled that Adair Circuit Court Judge James Weddle wrongly excluded some evidence from the case, so the high court ordered a new trial.

Brown was originally sentenced to Life Without the Possibility of Parole for 25 Years. He could have been given the death penalty. Since this is a retrial, he could still get the death penalty if the jury convicts him.
