A nine-month power struggle between the Russellville City Council and the city's Electric Plant Board may soon go before a judge.
Fred Greene, attorney for the Board said Friday he expects to file a civil lawsuit in Logan Circuit Court before the next city council meeting on July 22.
This latest move is in response to a 5-2 city council vote on Tuesday night that approved a municipal ordinance calling for the removal of the three remaining Electric Plant Board members. A full board is five members, but two members' terms expired in the past seven months, and have not been replaced.
The fight between the two municipalities began over the council's desire to change the ethical policy of the board, especially in the areas of travel expenses and health insurance. The Board maintains only it has the authority to institute policy changes.
A grievance hearing for the Board before the City Council could come as early as the council's next meeting on July 22.
