It's official, the Commonwealth will seek the death penalty in the Katie Autry murder case.

Stephen Soules' attorney, Zack Kafoglis entered a plea of not guilty at his arraignment Monday. Soules is charged with first degree murder, rape, sodomy, arson and robbery or complicity to those charges in the death of 18-year-old Katie Autry.

During the court appearance Assistant Commonwealth Attorney Mike Pearson announced the state would be seeking the death penalty. Defense Attorney Zack Kafoglis describes his client as a victim. Kafoglis says Soules was an "invited guest" of Katie Autry the night of her murder.

A request for bond was denied by Judge Thomas Lewis. Co-Defendant Lucas Goodrum was scheduled to be arraigned with Soules Monday. However, due to a scheduling conflict, Lucas Goodrum will be arraigned Tuesday.

Both men remain in the Warren County Regional Jail.
