Middle Bridge Area to Grow

Residents of the Middle Bridge community, fiscal court members and developers of proposed houses on that property met for nearly nine hours in fiscal court on Jan. 30, 2007.

The hearing was to listen to both sides present arguments on whether the fiscal court should overrule the committee's recommendation.

After closing arguments members of the fiscal court deadlocked at three votes a piece on the issue. Since magistrate Doc Kaelin was not in attendance there was not a seventh member of the court to give either side a majority vote, leaving planning and zoning's recommendation standing.

It wasn't the reaction that most Middle Bridge residents were hoping for. The three-to-three deadlock allows the planning and zoning's recommendation to stand. Therefore the developers, Calvin Alford and Middle Bridge Properties, are allowed to turn 97 acres into 65 individual lots.

However, the neighborhood still has its reasons why they think the wrong decision was made.

"This development is 780 percent more dense than the area surrounding it. Part two was traffic. These are some of the most substandard roads in warren county," one neighbor said.

"Well the recommendation was made on almost totally controlling evidence presented by the planning commission here today to the fiscal court. All of the experts who testified voted in favor of the proposed change," another neighbor said.

Middle Bridge resident's Attorney, Brent Travelsted, said he has concerns with certain elements of the case.

"When we first litigated this matter with planning and zoning commission, there was serious questions about a couple of votes because of conflicts of interest," Travelsted said.

Attorney for the developers, Whayne Priest said that the outcome was very emotional for all involved.

"Anytime you're in a situation like this with so much emotion, you're going to be upset whether its six to zero or three-to-three, but they were very emotional and I felt for them," Priest said.

Although, this chapter has been decided it seems to be far from over.

Travelsted said he believes that the residential group will probably appeal the decision in Warren County Circuit Court. They have 90 days to appeal with the circuit court before planning and zoning's recommendation will take effect.
