Judge Matt Baker is firing back at the Warren County Fiscal Court in the ongoing Beech Bend Road dispute.
The fiscal court declared a disputed 1/2 mile stretch of Beech Bend road to be county property at a hearing on December 19, but Judge Baker maintains the road is his private drive.
In the lawsuit, Baker makes three allegations:
- 1.) That the fiscal court's decision was "predjudiced" and "prejudged," and alleges that Beech Bend Park owner Dallas Jones improperly influenced one or more magistrates before the Dec. 19 hearing.
2.) That the fiscal court overstepped its bounds by declaring the road as county property.
3.) That the fiscal court violated Baker's constitutional rights by illegally taking away private property.
Fiscal court magistrates refused comment citing the pending legal action, and Warren County Judge Executive Mike Buchanon was out of town Thursday.
Beech Bend Park owner Dallas Jones, who is a co-defendant in the suit, said the charges are "totally false and incorrect."
Attorneys for Jones and Baker were in court in Danville Thursday for pretrial motions for a civil suit filed in June by Jones, attempting to determine legal ownership of the road. That trial is expected to get underway early next week.
