Comair Airlines is suing the Federal Government over a Lexington plane crash that killed 49 people.
The airline said the Federal Aviation Administration was negligent in having only one air traffic controller on duty when the plane crashed last year.
Comair 5191 crashed August 27, 2006, after it took off from the wrong runway.
The suit said the United States Government breached its duty to control taxiing and departing aircraft at the airport. The airline had previous filed a lawsuit against the FAA but it was dismissed Tuesday, Feb. 20, 2007.
