The Kentucky Court of Appeals has overturned a $300,000 award to a former University of Louisville assistant track coach after finding a lack of evidence that her firing was in retaliation for starting a sexual harassment investigation.
The court on Friday also threw out a $149,000 award to her attorneys for fees.
The ruling came in a lawsuit brought in 2008 by ex-assistant coach Mary Banker against the University of Louisville Athletic Association. Banker worked on the track coach's staff from September 2007 through June 2008. Banker was informed her contract would not be renewed around the same time she filed a sexual harassment complaint in April 2008.
Judge James H. Lambert wrote that the university showed Banker was let go for non-discriminatory reasons and Banker couldn't prove otherwise.
