JACKSON, Ky. (AP) — A judge has refused the state Department of Education's request to dismiss a lawsuit filed against it by an eastern Kentucky school district.
WYMT-TV reports Breathitt Circuit Judge Frank Allen Fletcher ruled on Tuesday that the case should proceed, but both sides should work toward reaching an out-of-court settlement.
The lawsuit seeks to put control of the Breathitt County school district back into local hands.
The Kentucky Board of Education gave management of the Appalachian school district to the state last year after audits found management and finances in disarray.
The lawsuit says Education Commissioner Terry Holliday took away the right of elected school board members to have a say in decisions affecting the district.
