FRANKFORT, Ky. (WBKO) -- A Franklin Circuit Court Judge issued an order that would allow former Senate President and Judge, David Williams' opponent to run against him in the 40th Circuit Election.
The district is made up of Cumberland, Monroe and Clinton Counties.
Williams' opponent Steve Hurt served as a 40th District Judge and retired as a Senior Status Special Judge.
He was seeking relief from a House Bill that could have prohibited him from running.
The bill said he couldn't run for any elected office because he was still in a five year term as a Senior Judge.
Judge Philip Shepherd in an order said this was unconstitutional. Shepherd said it is "incompetent for the Legislature to prescribe additional disqualifications not recognized by the constitution."
Hurt is listed as a candidate on the Secretary of State's website for the Judge's seat. The order also said the Secretary of State's Office could not remove him from the ballot.
It is a non-partisan race and will take place this year.
