The attorney for a former Cincinnati Ben-Gals cheerleader charged with having sex with a 17-year-old student when she was a teacher is asking a judge to throw out text messages in the case.

Sarah Jones is facing a sex abuse charge in the case. Her attorney, Eric Deters, alleged in a hearing Friday that Kenton District Judge Kenneth Easterling shouldn't have granted the warrant that led to the discovery of the text messages because he knew the victim. However, Easterling testified that he didn't remember having any prior contact with the teen and did not know his parents.

The Kentucky Enquirer reports Circuit Judge Patricia Summe did not issue a ruling over the motion to bar the text messages, which Deters said "are embarrassing" to his client.
