UPDATE: KY High Court to Take Up Instant Racing Challenge

FRANKFORT, Ky. (AP) -- Kentucky Supreme Court justices are weighing whether betting on historical races on a slot machine-like device is similar to betting on live racing or a form of illegal gambling.

The court on Wednesday quizzed attorneys from various racetracks, the Kentucky Horse Racing Commission and The Family Foundation of Kentucky about the validity of the game, known as Instant Racing.

The game allows patrons to bet on past races without knowing the names of the trainers, jockeys or horses involved. Kentucky Downs in Franklin and Ellis Park in Henderson each offer the game.

A Family Foundation lawyer said historic racing is essentially slot machine gambling, which is barred in Kentucky.

An attorney for the race tracks said there's no difference between betting on historic races and betting on live racing.


FRANKFORT, Ky. (AP) -- The Kentucky Supreme Court is set to step into a long-running dispute over whether a slot machine-like device is legal in the state.

The justices will hear arguments starting at 10 a.m. EDT Wednesday from the state and The Family Foundation, which is challenging the Instant Racing game. Each side will have 30 minutes to make its case.

The game allows patrons to bet on past races without knowing the names of the trainers, jockeys or horses involved. Kentucky Downs in Franklin and Ellis Park in Henderson each offer the game.

The high court case will focus on whether Instant Racing is a pari-mutuel game, like horse racing, or more like slot machine gambling, which is not allowed in Kentucky.
