State Won't Appeal Executions Ban

LOUISVILLE, Ky. (AP) -- Kentucky will not appeal a judge's ruling keeping a ban on executions in place, with state officials opting instead to fight out a lawsuit brought by inmates challenging the way lethal injections are carried out.

A justice cabinet spokeswoman says there will not be an attempt to rewrite the regulations for executions to deal with concerns raised by Franklin Circuit judge Phillip Shepherd. Shepherd did not object to the state's choice of drugs, or the one and two drug methods it proposes to use.
