The man accused of extortion in the case of late night comedian David Letterman appeared in court today.
Despite the fact the CBS news producer cashed a phony check written by the celebrity, the attorney for a clean-shaven Joe Halderman asked the judge to dismiss the attempted first degree larceny charge, saying there was no extortion and that his client was simply trying to sell a script to Letterman.
"This was a commercial transaction. It was nothing more. It did not violate the penal law." Gerald Shargel, Halderman's attorney claimed.
If convicted Halderman could be sentenced to up to 15 years in prison.
Letterman admitted to "horribly hurting" his wife, but the scandal has not hurt his show's ratings.
In fact, his audience is up 13% compared to last year.
