An 82-year-old Danville man accused of killing his neighbor now has a staph infection and his trial won't resume until early 2008.
Jack Caldwell is accused of gunning down Jim Trachsel more than three years ago.
The trial was delayed last week because of Caldwell's health and Dec. 5. The judge said because Caldwell has MRSA he can't leave the hospital until Jan.
"Everytime anybody from the hospital goes in theyr'e wearing gowns, masks, gloves," stated Ephraim Helton, Caldwell's attorney.
"Possibly that being contagious I think the judge has made an appropriate ruling based upon the circumstances that have been presented to him," added Richie Bottoms, Commonwealth's attorney.
Attorneys say they're optimistic Caldwell's health will improve.
