Man Dies As Result of Feud

Randall Short says: "What concerns me is that a man has died and something needs to be done about it."

Short represents the family of Dewayne Garner. Garner died April 26 from injuries he sustained in the Dollar General parking lot, in Morgantown. Garner's family says Jerry House is to blame. Garner's son, Cody, released a statement to the police as a witness.

In his statement, Cody Garner says Jerry House backed his truck up 47 feet in the parking lot, then punched the gas and ran right into Dewayne Garner.

Short says: "Mr. Garner was in a 45 degree angle from the windshield of the Blazer. His feet were sticking up in the air."

But Jerry House says that's not how it happened.

House says: "I saw guys get out of the Ranger and they had clubs and one of them jumped on my hood. I slammed on my brakes and he fell off."

House says he left he scene right after it happened because Cody was trying to get into his vehicle. And he says he immediately called 911 and went to the police station.

The Commonwealths Attorneys office and Kentucky State Police are investigating the incident.

But House doesn't think they will find him at fault. "Not really. To me, it was self defense. I mean what would you do if someone had done that to you?"

But the Garner family says House needs to accept responsibility for Mr. Garner's death.

Short says: "If you go to the Dollar Store here, and you look at the parking lot, Mr. House had all kinds of ways he could have gotten away. He didn't have to run the man down."
