Robert Shirley Loses Appeal

A Warren County man convicted of murder in a 2004 love triangle loses his appeal to Kentucky's Supreme Court.

In April of last year, a jury found Robert Shirley guilty of murder in the shooting death of Alfred Victor Michael.

Police say in January of 2004, Shirley came home to discover Michael embracing Mrs. Shirley in the kitchen.

Court records show Shirley then armed himself with a 38-caliber revolver and confronted the two before falling causing the gun to discharge.

Alfred Michael was shot in the head and died the following day at the hospital.

In a ruling this week, the Supreme Court disagreed with Shirley's argument that he shot Michael in self-defense or in defense of his wife.

The court says during the trial Shirley claimed the shooting was an accident therefore he could not also claim he acted in self-defense.

Shirley was sentenced to twenty years in prison which was also affirmed by the court.
