The Bush administration is asking the U-S Supreme Court to rule against a Jefferson County Public Schools' policy of considering race when assigning students.

The administration filed a legal brief this week arguing that the Louisville school district's voluntary integration plan doesn't pass Constitutional muster because it is essentially an illegal racial quota, which unfairly burdens some students.

Administration lawyers says the policy of the district, in which about 35 percent of the 97,000 students are black, violates the equal protection clause of the 14th Amendment.

The brief comes in the appeal of Crystal Meredith, a Louisville parent who is challenging the district's student-assignment policies. The case will be argued along with a similar issue from Seattle after the Supreme Court reconvenes in October.
