The Kentucky Supreme Court has ruled a wrongful death suit filed against the man accused of killing a UK football player.
In 1994, Trent Digiurio was shot in Lexington, Ky., while sitting on his front porch. Shane Ragland was arrested six years later, convicted and sentenced to 30 years in prison. But the conviction was overturned and Ragland has been granted a new trial.
Ragland’s attorney is now David Broderick of Bowling Green, Ky. Digiuro’s estate sued Ragland after his conviction but a judge threw out the case saying the one-year statute of limitation had passed.
In 2004 the Kentucky Court of Appeals reversed the decision and this week the State Supreme Court upheld their reversal .
