Retrial Date Set for Lonnie Freeman and Dustin Asher

Dustin Asher and Lonnie Freeman headed back to Allen Circuit Court on Oct. 17, 2006. The appearance was a status hearing, but several issues were covered.

The first item of business was a motion by defense attorney Daniel Taylor for a speedy trial for his two clients. Asher and Freeman are charged with murder and tampering with physical evidence in the 2005 deaths of Kelly Johnson and Danny Froedge. The two men were tried together earlier this month, but it ended after jurors deliberated for 10 hours and were unable to reach a unanimous verdict.

Taylor also requested bail for Dustin Asher. Judge William Harris said he can get out of jail, but he'll have to come up with $500,000 cash bond or a $1 million property bond.

Even though this trial received massive media publicity, there was no request for a change of venue.

Asher and Freeman will head back to court for a pretrial conference Feb. 16, 2006, at 10 a.m. Their new trial is set to start in Allen Circuit Court Monday, Feb. 26, 2007, and will last about two weeks.
