The lone survivor of the Comair Flight 5191 crash in Lexington has been named along with the airline in a lawsuit filed in Florida.
James Polehinke, the co-pilot who was at the controls when the plane crashed August 27th, has been named in a wrongful death lawsuit along with Comair.
The suit was filed by the family of crash victim Charles Lykins, yesterday. Attorney Steven Marks says the reason the lawsuit was filed in Florida was because Polehinke lived there before the crash.
Polehinke has been undergoing physical therapy at a Lexington facility since his release from the UK hospital.
