The suit was filed by the family of Cecil Moscoe, one of the victims of Comair flight 5191. The flight crashed after takeoff at the Bluegrass Regional Airport in August, killing 49 people.
The suit claims the aircraft design did not protect passengers from flammable jet fuel.
A spokesman for Bombadier, the maker of the plane model that crashed, says the planes are among the safest in the industry.
The suit seeks unspecified damaged from Bombadier, Comair and Comair's parent company, Delta.
At least 13 other lawsuits have been filed in connection to the Comair crash.
