A group of restaurants and bars are challenging Louisville’s new smoking ban.
They’re asking a judge to strike the ban down partly because it exempts Churchill Downs. The Louisville Metro Hospitality Coalition said the ordinance violates Kentucky’s Constitution by favoring certain businesses. The suit argues that the ordinance's inspection requirement would violate the state constitution. The ordinance passed by the Metro Council would ban smoking in most work places.
The ban is set to take effect in July.
