A family still in mourning over the loss of their son, takes their case to court.

A “wrongful death lawsuit” has been filed by the parents of Ryan Owens. Owens was the Henderson County High School football player who collapsed and died shortly after practice last July 19, 2007.

The 11-page action names Head Football Coach Duffer Duffy, his assistant Coach Tim Duffy and school superintendent, Tom Richey responsible.

The suit claims the coaching staff was “negligent ... In not seeking medical attention,” after the 16-year-old reported he was disoriented and having difficulty breathing.

The lawsuit claims the coaching staff, instead ordered Owens back onto the practice field in hot weather, in full football gear.

The suit also accuses the head coach of withholding water from Owens during practice.
