KY Supreme Court Reverses "Red Lobster" Decision
The Kentucky Supreme Court reverses a Court of Appeals decision in a case against Red Lobster, worth almost $250,000 dollars.

In September 2005, Tim Emberton sued the Red Lobster restaurant in Bowling Green, and its employee, Carissa Phelps, claiming they gave him Hepatitis-A.

A Warren Circuit Court jury found Red Lobster liable, and awarded Emberton $233,000.

In April 2007, the Kentucky Court of Appeals overturned the verdict, saying Emberton didn't file his lawsuit within the one-year statute of limitations.

But Thursday, October 29, the Kentucky Supreme Court reversed the appellate court's decision, opening the way for Emberton to get his money.
