A Western Kentucky school board has been dismissed from a lawsuit over the death of a student athlete.
Ryan Owens, 16, died July 2006 shortly after practice at Henderson County High School. A state medical examiner found Owens suffered from a heart defect exacerbated by heat.
Owens parents filed a suit in January reporting gross negligence in their son's death. A judge ruled the school board can't be sued, but it can go forward against the others.
The family still may seek compensation from the Henderson County Board of Education for the death of their son by filing an action through the State Board of Claims.
