Former Kentucky Supreme Court Justice William McAnulty is expected to be released from the hospital Aug. 13.
McAnulty stepped down from the state's highest court last week to undergo radiation therapy to treat lung cancer.
He was readmitted for a broken collarbone he suffered from a recent fall.
McAnulty was appointed to the court in November 2006 when he became the first African-American Supreme Court Justice in Kentucky.
