KY Court Upholds Dismissal in Fen-Phen Lawsuit

LOUISVILLE, Ky. (AP) -- The Kentucky Supreme Court has concluded that a group of 50 Kentuckians waited 15 days too long to file suit against law firms in Mississippi and Alabama as well as a Kentucky lawyer over their handling of a settlement involving the diet drug fen-phen.

Justice Daniel Venters wrote for a divided court that the a statute of limitations barred the suit against J. Brent Austin of Lexington, Langston, Sweet and Freese of Jackson, Miss., and Beasley, Allen, Crow, Methvin, Portis & Miles of Montgomery, Ala.

The Kentuckians were sent to the Mississippi and Alabama lawyers by three now-disbarred attorneys in a complex deal to help beef up both legal cases over the drugs.

The group sued in 2007 after concluding they received $29,000 each instead of $47,000 each.
