The Kentucky Supreme Court will decide if an inmate involved in a 2009 prison riot received a fair disciplinary hearing after an officer prevented any witnesses from testifying on his behalf.

The high court has not set a date for the case of 30-year-old Clifford Boards-Bey, who is serving 10 years in prison for burglary and theft.

Boards-Bey was convicted in the internal prison discipline system of trying to hurt a corrections officer during a 2009 riot at Northpoint Training Center. Boards-Bey denied attacking anyone but declined to testify at a hearing later that year at Green River Correctional Complex. A hearing officer ruled that because Boards-Bey chose to remain silent, he forfeited his right to question witnesses.

Prison administrators ordered the inmate to 180 days of disciplinary segregation.
