Franklin Circuit Judge Thomas Wingate figured he had to sober up the man appearing before him before handing down the punishment. So Wingate sent 44-year-old Kevin Jones to jail on Dec. 7 after a court appearance where Jones appeared to be high.

Jones told bailiffs that day he had taken cocaine and other drugs before appearing in court.

Wingate brought Jones back to court on Friday, sober and ready to be sentenced.

Jones pleaded guilty in October to second-degree burglary and carrying a concealed weapon. He was given five years of probation.

Jones was released with an ankle monitor until he can be sent to a drug rehabilitation center.

Wingate told The State Journal that going to jail for a month "has been the best thing for" Jones.
