Man Convicted in Death of Victim Found in Basement

A Louisville man has been convicted of complicity to murder and other charges in the death of a man whose body was found buried in a basement.

The Jefferson County Circuit Court jury that convicted Joseph Banis on Friday will return Monday to decide whether to recommend a death sentence.

Victim James Carroll's mother, 64-year-old Ellen Carroll of eastern Kentucky, told The Courier-Journal she is against the death penalty and hopes Banis is sentenced to life without parole.

Prosecutors said Banis and co-defendant Jeffrey Mundt robbed and killed Carroll in 2009 during a night of sex and drugs and buried the body. Mundt is scheduled for trial later this year and testified at Banis' trial.

Defense attorneys accused Mundt of lying and tried to shift blame to him.
