A Kentucky man is challenging his conviction in the 2006 shooting death of a woman in eastern Kentucky saying his attorney did a poor job at trial.

Timothy Scott Simpson of Ashland is scheduled to return to court Monday in Boyd Circuit Court. The Ashland Daily Independent reports that Simpson claims his attorney, Michael Curtis, failed to adequately represent him.

Clay and 28-year-old Faith Clay of Flatwoods had been living together for about three weeks when she was found dead on the couch with a gunshot wound to her right eye. Simpson was sentenced to life in prison for muder, plus five years for tampering with physical evidence

The Kentucky Supreme Court in June ordered a new sentencing for Simpson because Kentucky law does not allow a defendant to be sentenced to a term of years to run consecutive with a life sentence.
